No, it doesn't. It can be interpreted that way, but that's not the only way to read it.

It's not at all unjustified. It's right there in the T&C that those who get status comped get treated differently. As for being legally dubious, no. The wording is poor, but requires an illogical reading of the provision as a whole to achieve the interpretation you're looking for.
