But the HMCTS mediation service is limited, it will allow for one phone call with a maximum of an hour, they are ok but deal in quantity rather than quality. It does not allow for a proper ventilation of issues as its primary purpose is to save court time and resources.
Any mediation is not an adjudication, but rather a conciliation/facilitation. When the regs engage it is difficult for BA to justify their position and have to capitulate, or when they are reminded that their guidelines are not tramlines, concede the reasonableness of the actions of the other party.
HMCTS meditation does not allow for the nuances and complexity of many situations.
