I agree; the guy being given access to OP's room may be a civil matter, but, while I'm not a lawyer, I wouldn't be surprised if the recording rose to the level of criminality.

And speaking of lawyers, if you mention you're retaining counsel, the hotel's customer service agents will stop talking to you, and all communication from that point will go through their legal department. Only do that when you've exhausted all other options.

Actually I just remembered I was once given someone else's room. The desk clerk had just arrived for her shift and saw the rooms were already assigned. She saw my name and made a key for that room. Wouldn't you know - there was another guest with the same first and last name as me (and not something common like John Smith).
