I do agree agents aren't charging it.. However that's likely due to them not understanding there's an exclusion due to training..
I think it's because they aren't sure if they want free cancellations/changes for flights originating outside of NA to be permanent or not. If you look at the corresponding section of this page, Delta states the following:

"We continue to waive change and cancel fees for travel originating outside of North America."

Granted, this is for cash fares and not for award tickets, but based on that it sounds like Delta wants to keep the door open in case they want to re-introduce fees for these flights in the future.
