It occurrs to me that maybe the pilot maybe was short on fuel but overstated his "fuel emergency" to make some kind of point. Of course, that is why they are investigating.
If the reported language is correct it does seem a bit odd. I guess he could have been caught somewhere between "advisory" and "emergency".
