It's 45 minutes of fuel PLUS fuel for the diversion which is dynamic based upon the next suitable airport for the plane. In LGAs case, there are several other airports within minutes so it would be just a few minutes over 45 minutes.
It occurrs to me that maybe the pilot maybe was short on fuel but overstated his "fuel emergency" to make some kind of point. Of course, that is why they are investigating.
