Maybe it’s 6 of one and half a dozen of another here. When he saw the empty seat he maybe thought that could be used to solve the problem and the crew said no. In the video to the police it seems he said he swore.

Id say BA dropped the ball here in not researching downgraded passengers party before doing so. I’d also suggest he was firm in his arguments as a top QC would be.

i suspect BA will settle out of court. £4k is a small price to pay for them to avoid the expense, cost inconvenience and stress litigation would cause it’s crews and ground staff (Boarding gate and check in ?) that could be called as witnisses . This isn’t like Joe Public make a low offer to shut the passenger up or hope the passenger won’t want the hassle of legal action. He has the ability to do so very easily..

An interesting point in one article he says BA gave him a voucher and he wanted a cash refund so it does seem BA issued an FTV . I thought if BA were invoking the not travelling rule you don’t get a refund..
