Certainly much better to go after the party that created the situation, which would be BA first by downgrading and/or denying travel to part/all of the travel party, and second by choosing to return to the gate even though there were ways that could have facilitated an on-time departure.
I’m not saying Mr. Banner is any angel in all this, but the situation does squarely appear to have been made by BA, beginning to end.
And then BA can claim the costs of disruption from Banner, as per within the rights of the airline under CAA, and per CAA site airline can claim between £10k-£80k from the person disrupting, on top of the penalty fine.
