Indeed, there are no precedents I can recall that specifically deal with the alternative carrier issue - airlines will not be too keen to challenge this through the courts because they know the legislation is written purposely to err on the side of the consumer.

Conversely, passengers are reluctant to challenge the carriers because of the potential loss. I have had a number of cases where I’ve been instructed to proceed to trial but a doorstep settlement offered by the airline prevented argument at trial of the substantive issues.
