Agree with flyerCO that OP needs a lawyer. Cough cough, Gábor Lukács…

Unless OP can find some known cases on similar incidents, it’s better not to assume which laws are applicable and what court can make a decision. Even if it’s possible to file the case in court A under law B, it may or may not bring the best outcome OP can get, and it may or may not be the easiest/cheapest solution.
