Let's ignore the legalities and technicalities for a moment and let us just pose a more simplistic question... How would the rental company know who was driving? If a valet backs into a pole or something, will there really be a police report?

Not saying that it's not a valid (and interesting) question, but in the end, it probably doesn't really matter all that much.
