When I received the email for feedback on my CS call I typed out what happened and how I believed the answer was possible. A few days later a supervisor called me and said it could be done and he was taking care of it. I then had my tickets booked in F the whole way with the balance of the miles now in my account (32,000). Of course now I wish I didn't move the extra AMEX points over as they are now stuck in Emirates, but it is still nice that they corrected the issue.

The point of all this is that as thijsseh said you need to insist and not give up as it can be done.
So you received it as a partial refund?
