You're absolutely right. But, they've operated this way for years with impunity. On the rare occasion I'm flying HA interisland on a codeshare, I usually just do the $50 F upgrade at check-in which covers the baggage anyways. For me, it's not worth the time and hassle of a DOT complaint.
