You're inferring that AC has broken a promise, when it would be more accurate to say that they're communicating poorly in a way that's very easy to misunderstand.
If they say seats available for upgrade on a Latitude fare, and then it waitlists you, they ARE breaking a promise.
The clearance window is infinite, so if there are seats available, it should not be waitlisted.
