While that's theoretically a problem, I'm fairly sure I would 'win' against someone saving an aisle seat, if I were inclined to push it. I never have, I'm really confrontation adverse - but I've seen the battle play out several times, and the flight attendant has always just parroted the open seating policy, and the person asking to sit in the open seat has always gotten the open seat.
