I have a Tumi Alpha 3 Continental version and it is slightly over the limit of most airlines but as a data point...I've never been asked to check it haha.
Unless your bag is quite OBVIOUSLY over the limit, I don't think I've met any gate agent that would force you to put it in the sizer as it really holds up the boarding process.
