I think the ambiguity in the T&Cs is that is more about the waiver of fees for spouses/DPs. It could be interpreted as spouses/DPs do not incur a fee, but they must still be listed on the contract in order to be authorized to drive.
I have a rental this weekend in ATL and Mrs. Lee will go with me to pick up. I'll ask the same question and report back. In my case I want to make very sure we're covered as the reservation is in my name but she will be driving the car without me at times.
