Hopefully some day someone will have a data point around this, and whether any insurance claims person has ever first looked into what discount code was used. I think it is arguable whether using a CDP is "fraud or misrepresentation" if Hertz doesn't ask you for identity and hasn't been shown to strictly enforce identity requirements. However, like you said, if you're dealing with significant damages, it's safe to assume there are going to be some lawyers involved that are going to look for any denial reason.
