While I hate to depend on customer service gestures because they can be lousy, they are sometime decent, especially if you regularly use the carrier. Are you kidding? Once you DOT and/or chargeback, your issue gets escalated to a much more empowered team to resolve these matters. Since the carrier has to report back to DOT, they have incentive to settle the issue. In fact, they will likely throw CS under the bus and say they were able to resolve it when CS wans't. Similarly, with the chargeback, if you can agree to an amount, everything should get dismissed.

Obviously you don't do this until you've failed with CS, but this is basically going above CS's head, which is what you want if they're not being reasonable.
