I guess I wonder what the right answer is here... if I pay $1000 for a penthouse suite at a property without a reservation guarantee, and all they have at check in is a $100 closet room, what are the outcomes?
1) Decline the room and... get a refund? Or am I obligated to accept the lesser room?
2) Accept the room and... implicitly waive any claim for the difference in room rates, like a voluntary downgrade, even though it's only as "voluntary" as a Hobson's choice? I assume nothing in the T&Cs provides a remedy in the form of a reduced rate, so you'd be left at the mercy of the contract law of the prevailing jurisdiction, or perhaps worse, arbitration.
