I went online and discovered there is still one in South Florida near MIA. Looking through the website menus, I noticed a disclaimer on the bottom.

It states:
To help offset increased labor costs due to new local, state, and federal ordinances, a 3.5% surcharge is included on all guest checks.
There are no local or state ordinances requiring minimum pay requirements and the federal minimum wage seems to be an annual thing. I won't be eating there anytime soon, and if they are doing this to offset labor costs, they should raise their prices 3.5% instead of adding a surcharge.
