I don't think Kroger sends L3 data to AMEX as I haven't had a problem with GCs at Kroger stores. Nevertheless, as a precaution, I always split the transactions and place the actual GC fee portion on a different card so they can't do any forensic accounting and divide by the $5.95 fees...
