Sure, you can mobile deposit these instruments.
The only thing that MG is doing is warning you up front that if something goes wrong with the deposit, no matter who is at fault, that they are free and clear of liability for replacement of funds.
If you are okay with those conditions, continue on.
It is only when things go boing in the night and complaints arise that people suddenly "become aware" of that little statement.
