The entire credit card chargeback mechanism is operating outside of the normal judicial system.
Hence, I doubt that AMEX wants a court to take thorough look at that.

Yes, credit card issuer sue their cardholders -> but it's usually not about disputed charges.
OP's situation really does come back to the underlying problem of not documenting the chargeback with the initial dispute. While phone calls and chat windows seem efficient, they are not. The fact that Amex did not ask for documents is not relevant. Amex is not looking out for you.

I would start the entire process over again and the wording and the documents to those which specifically inform the entitlement to a refund. In particular, the COC and fare rules which apply here (just screen shots of the relevant parts).
