If the fine print says if the aircraft is changed and there is no longer a first class seat, you don't get a refund then that is the fine print of the contract OP signed when he bought his ticket. If the rules say differently, he is entitled.
Regardless of the fare rules, downgrade refund under EC261 would apply.

Even putting that to one side, I can't see any circumstances where BA would not offer some partial refund based on the downgrade. I am not aware of any fare rules like you suggest.
