UA has all the power here by its own decree - ‘reserving the right to change the terms of MP at any time’ or what not. The courts have blessed it. Congress doesn’t want to interfere... But power is one of those things - if you abuse it (and it’s of course perceptual), then your credibility and, eventually, equity will decline, and then the price you can charge for your product erodes - unless the competition is doing the same. All this is difficult to monetize, I admit. The way I would run MP, an extension of UA, which UA has sometimes done, and sometimes not - certainly not here, is to announce a change July-October 2020 (so in two months...) for the 2022 program year as customers earn benefits in 2020 to be enjoyed in 2021. That’s how customers view it. UA violated that fairness principle here - not a legal principle - and is suffering a loss of goodwill. And I don’t buy the Covid exception argument. UA is a big business and not a victim any more than its customer. The price you pay for being big!
