Your non-professional opinion is correct. Pilot did not read back the hold-short instruction, and the controller didn't insist on it. This exact sort of scenario is why all hold-short instructions are required to be read back (including aircraft ID and runway number - you can't just respond with "holding short" anymore.) So both of them are going to be in a bit of trouble.
The pilot never received a clearance to cross. It doesn't matter if he read back or not . ATC would be wrong, If he had received clearance to cross, then ATC instructed to hold short and pilot didn't feedback.
A pilot may not cross a runway without ATC clearance. DL300 never had this, and never read back anything stating he did.
