However both the small claims courts and the Alternative Dispute Resolution service have generally found in favour of the passenger when cases are brought to them (not in 100% of cases). In essence both the courts and the ADR body (CEDR) have agreed that this is "extraordinary circumstances", but that BA has not taken all reasonable measures to mitigate the issue from a passenger perspective.
