According to the initial report, there were a number of human factor points in the chain of events. They went through an active thunder storm area, one that the SU operations manual explicitly instructs to request to avoid. Despite 3 SU flights before requesting to avoid, and 10 after requesting the same SU1492 went through the area without a request to avoid. It was clear from the CVR that they had noticed a lot of weather activity in that area. On approach they got "WINDSHEAR" and "GO-AROUND, WINDSHEAR AHEAD" warnings for 11 seconds recorded on the CVR and no discussion of these by the cockpit crew. SU operations manual require them to go around at this point, which they did not. They landed with the avionics in direct mode (manual) armed the speedbrakes for landing, but failed to take appropriate action as speedbrakes don't deploy automatically in direct mode. The CVR makes it clear that they were aware the the system had switched to direct mode. Before landing the controller asked if any assistance was needed, and the response was "No so far everything is normal, standard", so there were no obvious grounds for avoiding a go around.

Is that enough for a criminal charge? I don't know, and I don't know if the criminal charge under Russian law means more than an initial indication of neglect and contributing actions. But I would say that the cockpit crew played a very big part in this accident happening.
