I can see that ending poorly...

That' s not the same. If the pilots are arrested and charged it' s a matter of public record. Force the airline to put the reason as to why the flight was delayed and let the passengers who are delayed on this flight and any other flight down the line ( since the plane was probably used for another flight after) sue the airline and those two pilots for any damages they may suffer as a result of the delay. I' m pretty sure the airline and those pilots would pay up rather than deal with hundreds of lawsuits.
