Mr. Gilmore MIGHT find success in challenging the unpublished nature of the ID regulations. But I am sure he will find no more success than that.

The bottom line is this: Mr. Gilmore could have flown, but chose not to submit himself to an otherwise legal search. By extension, the government can not be said to have committed a violation of the loosely defined "right to travel" if they never did actually deny him that right.
