Exclamation It is a real class action, but it is also a fraud.

It is real, but it is a "fraud" in the sense that class action lawsuits benefit the lawyers, the administrators and other parties, but not the consumer.

Qgem is a bulk email provider who specializes in class action lawsuits. They will make a cool million off the lawsuit as well.

The lawsuit is being administered by an all too well known scam company called Rust Consulting. They get millions by administering class actions, but they are a scam. They typically randomly pick names and contact info of the alleged class members off mailing lists rather than doing what they are paid to do. Ultimately they will be responsible for distributing the proceeds, and nobody is looking over their shoulder.

The system is set up by lawyers for lawyers. That is why a 60 million dollar lawsuit often results in less than a dollar for each of the alleged class members. Seldom will even 10% of the actual victims see any money at all. Why? The system is corrupt, and most of the people who are listed as class members are likely not actually patrons of the party that was found to be at fault.

I am 53, and I have seen this many times. I once received a settlement of $2 connected with baby formula. My wife and I have no children, and have never bought any baby products. Another time I received a settlement notice connected with swimming pool products. We have never owned a swimming pool. The list goes on.

This specific settlement is the most disgusting one I have ever seen. Not only did I not purchase any domestic airline tickets, but I was not living in the USA for the entire period. Why am I listed as a class member? It is simply because Rust Consulting has my name and it gets pulled out at random.

I contacted Rust Consulting and confronted them. I demanded to know what records indicate that I have purchased airline tickets from one or more of the defendants. Their reply was, "At this time, there is no flight data available to us.". The statement completely contradicts the opening statement in their letter: "Our records show you may have purchased a domestic airline ticket from American, Delta, Southwest, United, Continental Airlines, or US Airways between July 1, 2011 and June 14, 2018.".

It is clear to me that if they have any records at all, they did not look at them. Looking at the records means that they must hire interns, and provide them with office space to work, etc. Why would Rust Consulting do anything honestly when they have impunity form the law? They went the less costly route, and pulled names mailing lists at random. They figure nobody will complain so long as they think they have a settlement coming. There are no rules that dictate how they handle the cases, so they can do as they please and nobody will do anything about it.

I opted out of future emails. I notified qgm that they are to globally block my email from any and all class action notices. They responded by disabling the personal link in the email that they sent me. The link dies not directly go to "domesticairclass com". Yes, the link in the email notifies them when you click it. If you copy the link from the letter, and post it on the internet, a log (linked to you) is created every time someone clicks the link regardless of where you post it. It is sort of like a "spy beacon". If you do not believe me, then go to the email, and right click on the link, and select "copy link address". The link goes though qgm, and has a tag in it that identifies you. Dodgy businesses often use that trick.

But wait, there is more! The lawsuit has a "poison pill" in it. Go here, "domesticairclass com/FAQ", and then click on "What is the difference between objecting and asking to be excluded?". Read the last line: "If you choose to exclude yourself or object to the Settlement(s), Court filings of exclusions and objections will publicly reveal your identity.". How lame! If you chose not to support them in their landfall money making opus, they will publicly reveal your name.

Keeping my name off records is my sole reason for objecting. I had my identity stolen once, so I am careful about where my info gets posted.

Please excuse any typos. I am vision impaired, and my eyes hurt this morning, so I am not wearing my "coke bottle" glasses.
