It doesn't matter what the FAA reg is or isn't. Some people are under the mistaken belief that the window shade is somehow the property of the holder of the window seat. It isn't. The airline owns the aircraft including the window shade and it will be positioned as the airline chooses for landing and departure. The agreement or approval of the passengers is not required.
