It's not avoiding inspection. Customs will still inspect the bag before it enters the US.
Baggage shows up late all the time. CBP doesn't sit there verifying the airline baggage scan data against the flight the passenger arrived on as part of inspection.
And the passengers are submitting a customs declaration anyway, as it’s part od using GE, APC, MPC or paper forms to be admitted into the US with or without checked luggage to claim. The important thing is to be truthful if asked about whether or not you have all your luggage.
