BA0983 refusing Compensation
Hello,
Our flight from TXL-LHR on December 18th was delayed by more than 3 hours. The reason for this was caused by a broken airplane coming from Paris to London Heathrow that morning. The airplane used to fly to Berlin afterward but unfortunately, it was broken so a new replacement airplane was on the way. The original scheduled arrival time for my flight BA 0983 was 14:55, but the plane arrived more than 3 hours later at 18:04 local time, therefore, I’m eligible for the compensation, right? But today I got this response from BA:
Thanks for contacting us about your EU compensation claim. I apologise for the delay in replying to you.
I'm sorry it was necessary to delay you flight from Berlin and I understand how annoying this must have been for you.
Your claim’s been refused because BA0983 on 13 December was delayed due to several operational circumstances outside of our control, which prevented the aircraft operating as scheduled. Under EU legislation, I’m afraid we’re not liable for a compensation payment in this situation.
We take all reasonable measures to avoid delaying a flight and we always consider if there are any operational options available before we make a decision. We’re very sorry the delay was necessary in this case.
We also got an Information letter about compensation in TXL on that day too. The Informations which we got was from the Captain and the Crew themselves. What can I do here now?
