what does art 82 of the gdpr say out of interest? i have searched and read what i think is art 82 but i am struggling to see what the compensation is due to the individual over the actual financial loss suffered if there is an actual loss.
My understanding is that an individual can claim for material and non-material damage. I am not an expert but I guess the non-material element might inlcude time spent sorting issues out such as cancellling cards and general distress and worry. It would be for the claimant to put a quantity in the claim and submit it to the data controller of the company concerned. The data controller can choose whether to seek more information. settle the claim, make a counter offer or reject the claim. If unhappy with the response court action remains an option.
