You must not be from Chicago. We routinely get 50-60 people shot in a weekend, and nobody ever sees anything. Battery #1 happens a gazillion times a day, few LIKE it, but it is rarely made an issue of. Battery #2 , was getting hit by a bag, the OP didn't even know if it was intentional. Assault #1 , the OP doesn't remember what was said, just the gist of it. If he isn't sure, others not paying attention to the OP as much as the OP may not have made any note of it. This is **NOT** to excuse the behavior, but when the ding of the brakes being set happens, and people all stand up at once, people will often bump, often get hit my bags, and often, not pay attention to others, they are focused on preparing to disembark.

{T}o state that it is unbelievable in the scrum of preparing to disembark that others may not have noticed is ignoring the facts of the post brakes set "ching" behavior. It's a scrum where people aren't sitting back observing, they're getting up and gathering their stuff and rushing to the front, often hitting people with their bags and bumping/touching others.

Sounds like this guy (the other guy) was a jerk, sorry the OP regrets not pressing charges, but if one wants to file assault and/or battery charges, one needs to file them. One can always drop them later, but to file them after the person has been released without any 411 on them is an uphill battle.

OP, I've pressed charges against a passenger's battery of me, it was far more serious (he choked me, and right under a surveillance camera.) The CPD relayed his "if I apologize, will he not press charges?" request to me,,..as if! (I laughed at them.) The satisfaction I got from making him take time off work, hire a lawyer, and fly back to the jurisdiction was great. The 6 month supervision (which as the guy neither works nor lives in the jurisdiction) as a sentence as his punishment was not worth me coming back from my vacation a week early to go to court. Judges are extremely lenient, at least in Cook County on battery, unless one ends up injured. By the way, my guy was a repeat batterer, but as he gets supervision, and the City of Chicago prosecutor didn't run a background check where he lives (FLA) until I requested it (the case was already in front of the judge), he continues to get just warnings.

My advice, try to move past it at this point and hope he gets his one day.
