As LondonElite said, every EU or US Airline has the same understanding of the rules and it doesn't matter if you avoid OS. Remember, ground-handling it outsourced most of the time... So the same guys unloading or loading OS flights might load another carriers flight.... The only option is to go by car or train from now on to avoid such issues.
What really intrigues me is, how to you plan to take this case to a court outside of Vienna? You willingly entered the contract with OS and explicitly accepted the T&C and CoC when you bought the ticket. As long as the T&C or CoC doesn't contain something total ridiculous like "You owe us your soul from now to whenever hell freezes over", that terms apply and I have seen it numerous times that courts will dismiss such cases if not proceeded in the court as stated in the CoC. If you really want to contribute anything meaningful here to the community, this could be your chance... I bet a lot of people would find it very useful to know how to get around such terms in the CoC...
