It is a standard practice for each party to maintain their own positions.

Not necessary. But again - it does not matter as the parties have settled.
As I have said previously, just because one side does not have a case at all, it does not mean a settlement can't be reached.
The purpose of a settlement is simply to end the disputes. Once the settlement has been reached, the settlement agreement will become the merits of the case for the Court's consideration.
