It's a requirement for any carriers departing the EU, or any carriers based in the EU. It doesn't apply to any airlines flying into the EU (which could be considered operating in the EU)... Unless it's actually an EU based airline (ie: BA, LH etc..).

It's European Union (ie: EU) Regulation (EC) 261/2004. I can see the confusion here, I wonder if any airline has declined requests based on people quoting EU261
