Perhaps it's the behavior of carriers like Qantas which is why the law is written the way it is.
Interesting comment. Perhaps the alternate is that while there is over-selling, the number of IDBs in Australia is not sufficient to warrant legislation. The Australian government likes to legislate to "protect the little people". If it was a major issue in Australia, there'd be legislation.
