If the over flow drain in the bath tub it not functional I would say that both the guest and the hotel have equal responsibility. Before checking out I would get someone from the hotel to document everything with both the guest and hotel in agreement.
yes I have a similar case, however the water was not running at the faucet and tub. And so i checked out not knowingly i had left the faucet nob on, which also drained slowly, and when the water pressure did come back on it flooded the room. There is no room below and it was completely tiled. Should I be accountable for that.
