I doubt you will have problem. I'd present it like this. "Looks like there will be construction going on and the pool closed during my stay. This was not disclosed at time of booking, so I'd like to make other travel plans." My expectation is they cancel (sans penalty) without blinking-especially if your plans are to book another Marriott.
