Revisiting this thread because it turns out BA is using this incident at Bologna to claim extraordinary circumstances/knock-on effects against a EU 261 claim we are making. We had CE tickets GLA-LHR and OH (travelling in party) is gold.
Our flight BA1497 (GLA-LHR) scheduled for 20:35 eventually departed/arrived more than three hours late and, after several letters to-and-fro, BA are still claiming this was outside of their control because of events earlier that day concerning other routes of their European operations/no available aircraft knock-on effect. Several other BA/Ryanair/Easyjet flights operated to schedule LHR-GLA and GLA-LHR that evening and it was just our aircraft that was delayed because of the hiatus in Italy. The captain's statement at the time was that the delay was compounded by a first replacement aircraft suffering a collision with ground equipment at LHR so yet another aircraft was sought at LHR to travel up and get us. It seems like a straightforward case to me but BA are holding fast. Would you think this was worth pursuing with CEDR or should we give up?
