I would go with taking it back to the retailer or using the "purchase protection" plan on your credit card (hopefully it's a gold or platinum card). Maybe, just maybe, someone at customer service at the airline might send you a travel voucher or some miles.

On a side note, I've had WN request that I sign a waiver before when I've checked bags that had obvious prior damage (e.g., a missing pullman handle).
