I'd exercise some caution. I am not a lawyer, and I don't play one on the internet, but there was an interesting discussion recently here, around a related issue, albeit a faulty CW seat. See here:

And there is some interesting reading in there, specifically Stott vs Thomas Cook. Some actual lawyers were of the opinion that any such action against BA was bound to fail.

It would be helpful if the OP were to set out what redress specifically they were seeking? What outcome do they wish to achieve.

(I assume seat booked and paid before they were Gold, since it would be free to a GCH.)
