I disagree. As it stands, it is undisputed that the plane was delayed 3 hours (but less than 4 hours) due to circumstances that were not exceptional. As such, AY has agreed to pay the applicable EU261 compensation of EUR 300. In other words, it is not an "amicable settlement" or "good will payment", but due compensation from AY to
csutter. The dispute as to the remaining EUR 300 has (should have) no impact on whether AY pays the initial EUR 300.
