In brief, the CDB stated that 25 minutes of the delay in question was attributable to a signal by the ground staff at the gate in BKK causing the plane to stop too far from the gate (it took 25 minutes to tow the plane 2 meters). After deducting 25 minutes from the total delay, the delay was less than 3 hours and the consumers were not entitled to EU261 compensation.
This is only a Consumer Disputes Board ruling, so it is not legally binding even in Finland. However, you can be 99.9% sure that Finnair will not voluntarily pay up in cases where a Consumer Disputes Board ruling suggests they are not liable.
