That's why it would be deemed a no-fault shooting. If anything, the hotel would be sued.

Take a look at this thread and imagine what could have happened to the occupant. Basically, some off-duty employee entered the poster's room through the adjacent room (connected) in the middle of the night and woke him up in the process of stealing things.
