I believe it is pretty easy: The hotel has the burden of evidence that the OP agreed to a higher rate. If the OP signed something or agreed verbally (and the hotel finds evidence for that) the OP is obligated to pay, if not, it is a free upgrade. The PR disaster for that specific hotel, however, is higher than any 300, 600 or 1000 USD they could have made from that one off deal.
